Terms and Conditions — France


These terms apply to every order placed on desky.eu and to your use of the website. The website is operated by Desky Sp. z o.o. (“Desky”). In these terms, “we”, “us” and “our” refer to Desky, and “you” refers to you, the customer.

Please read these terms before you order. They set out who you are buying from, how the contract is made, what you pay, when your order arrives and what to do if something goes wrong.

Nothing in these terms limits the rights you have under mandatory consumer law. If a clause conflicts with a mandatory rule that protects you, the mandatory rule applies instead and the rest of these terms stay in force.

2. Who these terms apply to

These terms apply to consumers and to business customers. You are a consumer if you buy for purposes that are mainly outside your trade, business, craft or profession. You are a business customer if you buy in the course of your trade, business or profession, including where you give us a company name or VAT number at checkout.

Section 23 adds terms that apply only to business customers. Where section 23 differs from the rest of these terms, section 23 applies to business customers.

You must be at least 18 years old to place an order. If you are younger, you need the consent of a parent or guardian.

3. Where we deliver and who can buy

We deliver to addresses in Austria, Belgium, France, Germany, Luxembourg, the Netherlands and Poland.

Anyone in the European Union can buy from desky.eu on the same terms, at the same prices and with the same payment methods, wherever they live or whatever their nationality, as long as the delivery address is in one of those countries.

4. Contract language and your copy of these terms

You can conclude your contract with us in English, German, French, Dutch or Polish. Your contract is concluded in the language in which you place your order, and that language version of these terms applies to your order. If you live in France, we also provide these terms in French, and the French version prevails.

We store the text of your contract. After you order, we email you an order confirmation with the details of your order, with these terms, our withdrawal instructions and model withdrawal form, and the legal guarantee notice attached as PDFs. Please keep or print that email. Your order details also stay available in your customer account, if you have one, but the version of these terms that applied to your order is only in the email. You can view, print or save the current version of these terms on this page at any time.

5. How the contract is made

The products on our website are an invitation to order, not a binding offer.

To order, add products to your cart and go to checkout. Enter your email and your delivery and billing details, then choose a payment method. Before you place your order, checkout shows a summary of everything you are ordering, the total price including VAT and any delivery costs, and your details. You can correct any entry at any stage with the edit links in checkout, or by changing your cart, until you click the order button.

When you click the final order button (for example “Pay now”), you make a binding offer to buy the products in your cart.

Our contract with you is formed when we send you the order confirmation email, or when we take payment through your chosen payment method, whichever happens first. We normally send the order confirmation immediately after you order.

6. Prices, VAT and delivery costs

All prices are shown in euro, or in Polish złoty (PLN) for delivery to Poland, and include VAT at the rate that applies in your delivery country.

Standard delivery to all the countries we deliver to is free. The total shown at checkout before you order is the total you pay. We never charge delivery or other costs that were not shown to you before you ordered.

Our prices can change, but the price that applies to your order is the price shown when you placed it.

Where we advertise a price reduction, we also show the lowest price at which the product was offered in the 30 days before the reduction.

7. Payment

The payment methods available for your delivery country are shown at the start of checkout. They are:

  • credit and debit cards (Visa, Mastercard and American Express), Apple Pay and Google Pay, processed by Shopify Payments;
  • PayPal, provided by PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg;
  • Klarna, provided by Klarna Bank AB (publ), Stockholm, Sweden, under Klarna’s own terms. Klarna may run an identity and credit check before offering you its payment options;
  • pay by bank, provided by Quidkey, using the bank payment methods offered for your country at checkout.

Card, Apple Pay, Google Pay, PayPal and pay-by-bank payments are taken when you place your order, including for pre-orders. Klarna payments are due as set out in Klarna’s terms. We do not charge any fee for any payment method.

If a payment is declined or reversed, we will not dispatch your order until payment is made. If payment is still not made after we have asked you for it, we may cancel the contract.

Your order remains our property until we have received payment in full.

8. Delivery

We ship every order from our warehouse in Łubna, Poland, using DHL, GLS, DPD, FedEx or UPS, and InPost in Poland. Orders normally arrive within 3–5 business days of dispatch. The estimated delivery time is shown on the product page and at checkout. Full details are on our Shipping page.

Unless we have agreed a different delivery date with you (for example for a pre-order, see section 9), we deliver within 30 days of the contract being formed at the latest. If we do not, you can give us a reasonable additional period to deliver, and if we miss that too you can end the contract and we will refund you in full. If we agreed a delivery date with you that was essential, you can end the contract straight away if we miss it.

Desks usually arrive in more than one parcel, typically a frame carton and a desktop carton, or three cartons for larger and L-shaped desks. Parcels can arrive on different days. Nothing is missing from your order if only one parcel has arrived.

Our carriers deliver to the ground floor or your front door. They do not carry items up stairs or into rooms.

If the carrier cannot deliver despite giving you reasonable notice and the parcel comes back to us, we will contact you to arrange delivery again. If the delivery failed because of the carrier, we redeliver free of charge. If it failed because no one was available to accept it despite reasonable notice, or because the delivery details you gave were wrong or incomplete, we charge the actual cost of redelivery. We will tell you the cost before we redeliver, and we will not redeliver until you have agreed to it. If it is not clear why the delivery failed, we treat it as the carrier’s fault.

Risk of loss or damage passes to you when you, or someone you name who is not the carrier, take physical possession of the goods.

If your order arrives damaged, please tell us as soon as you reasonably can, with photos or a video if possible. This helps us claim from the carrier and get a fix to you faster. If it takes you longer, you lose none of your rights, including under the legal guarantee.

9. Pre-orders

Some products can be ordered before they are in stock. We mark these clearly as pre-orders on the product page and at checkout, with an estimated dispatch period, for example “late October”. The estimate is based on manufacturing and shipping timelines. It is not a guaranteed date and can change.

By ordering a pre-order product, you agree that we will deliver it after the 30-day period that would otherwise apply (section 8): within the estimated dispatch period shown at checkout, plus the normal delivery time.

  • If your order contains both pre-order and in-stock items, we ship the whole order together once every item is available. If you would like the in-stock items sooner, contact us and we will split your order at no extra cost.
  • If the estimated dispatch period changes, we will email you with the new estimate. You can keep your order or cancel it.
  • You can cancel a pre-order at any time before it is dispatched, for any reason, and we refund you in full. Email help@desky.eu with your order number.
  • If we cannot supply a pre-ordered product at all, we will tell you, cancel that part of the order and refund you in full without undue delay, and at the latest within 14 days.
  • Your 14-day right of withdrawal runs from the day you receive the goods, not from the day you pre-order. Cancelling a pre-order before dispatch does not use it up.

10. Your right of withdrawal and our 30-day returns

As a consumer, you can withdraw from your contract within 14 days of receiving your goods without giving any reason. Our Right of Withdrawal page explains how, and includes the model withdrawal form and the online withdrawal function (“Withdraw from contract”), which you can use at any time without logging in.

On top of your legal right, we give a voluntary return period of 30 days in total from delivery, with free returns and a prepaid label. The conditions for days 15 to 30 are on our Returns page. The voluntary return period does not limit your right of withdrawal or your legal guarantee.

11. Legal guarantee and the Desky Warranty

Everything we sell comes with a legal guarantee of conformity of at least 2 years from delivery, free of charge. The goods must match their description, be fit for their normal purpose and have the quality and durability you can reasonably expect. If they do not, you can ask us to repair or replace them. If that is impossible, disproportionate, not done within a reasonable time, or the problem is serious, you can ask for a price reduction or end the contract and get your money back. The Legal Guarantee notice, linked at the bottom of every page, summarises these rights.

Legal guarantees

The Desky Warranty of up to 10 years is a voluntary commercial warranty we give in addition to the legal guarantee. It does not limit or replace your legal guarantee. Details are on our Warranty page.

12. Product information and errors

Product descriptions and specifications on our product pages form part of your contract. Other content, such as buying guides and articles, is general information.

We have made every effort to display the colours and images of our products as accurately as possible. The colours you see depend on your screen. Natural materials such as bamboo and hardwood vary in grain and colour from piece to piece.

We may set a maximum quantity per order for a product. Any limit is shown before you order. We may stop offering any product at any time. That does not affect orders already placed.

If an obvious error in a price or product description means your order does not reflect what we meant to offer, for example a desk listed at €1, and the error should have been apparent to you, we will contact you without delay. You can then either confirm the order at the correct price or cancel it and receive a full refund. Where there is no obvious error, we honour the price and description you ordered on.

13. Discount codes, promotions and gift cards

Unless the promotion says otherwise, discount codes apply to full-price products only, are not valid on past purchases, cannot be combined with other discount codes and can be used once per order. A code cannot be exchanged for cash. Any other conditions, such as a validity period, minimum order value or eligible products, are shown with the promotion.

If you return part of an order that used a discount, we refund the amount you actually paid for the items you return.

Desky gift cards can be used to pay for products on desky.eu. They do not expire and can be used across several orders until the balance runs out. The balance cannot be exchanged for cash, except where the law requires. If you withdraw from an order you paid for with a gift card, we refund that amount to the gift card unless you ask us to refund it another way.

You can withdraw from the purchase of a gift card within 14 days of buying it, as long as you have not used it.

14. Your customer account and our other online services

Alongside the online store, we provide these services free of charge: a customer account; our newsletter; our contact, return request and warranty claim forms and the online withdrawal function (“Withdraw from contract”); product reviews; and live chat, which may be answered by an automated assistant. If you are chatting with an automated assistant, we tell you, and you can ask for a person at any time.

To use them you need an internet-connected device, a current version of a common browser (such as Chrome, Firefox, Safari or Edge) with JavaScript and the necessary cookies enabled, and an active email address.

A contract for a service starts when you start using it, for example when you send a form, create an account or subscribe to the newsletter. It ends when the form is sent, and for your account and the newsletter it runs until it is ended. You can end it at any time and at no cost, by deleting your account in your account settings or by emailing us, and by using the unsubscribe link in any newsletter.

Please keep your account details accurate and up to date, and keep your password secure.

We may close your account with 14 days’ notice by email for a valid reason, such as closing the service. We may suspend or close it straight away if you seriously breach section 15 or 16, for example by posting unlawful content or attacking the security of the website. Closing an account does not affect orders already placed.

Any online service carries risks, such as malware and phishing. We use encrypted connections throughout the website, and card and bank details are handled directly by our payment providers. We will never ask for your password by email or phone.

Your personal information is handled under our Privacy Policy.

15. Using our website

You must not use the website or its content: (a) for any unlawful purpose, or to encourage others to act unlawfully; (b) to infringe our intellectual property rights or anyone else’s; (c) to harass, abuse, insult, defame or intimidate anyone, or to discriminate against anyone; (d) to submit false or misleading information; (e) to upload or transmit viruses or other malicious code; (f) to collect or track other people’s personal information; (g) to spam, phish, or scrape or crawl the website by automated means; or (h) to interfere with or get around the security features of the website.

The content of the website, including text, images, product photos, videos and design, belongs to us or our licensors. You may not copy, reproduce, sell or otherwise exploit it without our written permission, except for your own private, non-commercial use.

We may change, suspend or stop any part of the website. This does not affect orders you have already placed.

The website may include tools provided by third parties and links to their websites. Those tools and websites are governed by their own terms and privacy notices, and we are not responsible for their content. This does not affect our responsibility for the products we sell to you.

16. Reviews and other content you send us

When you post a review or send us other content, you give us a free, non-exclusive licence to publish, reproduce, shorten and translate it on desky.eu, in our other Desky stores and in our marketing, for as long as it is published. We will not change its meaning. You can ask us to remove your review at any time.

Your content must reflect your own genuine experience. It must not be unlawful, defamatory, abusive or obscene, must not infringe anyone’s rights, must not include other people’s personal information and must not contain malware. You must not post under a false name or pretend to be someone else.

How we check reviews. Reviews marked “Verified buyer” come from customers we invited to review after they received an order from a Desky store. Other reviews are not checked against a purchase. Some reviews were written by customers of our Desky stores in Australia and the United States about the same products. We publish both positive and negative reviews. When you post a review through our invitation, we refund EUR 5 (or the equivalent in PLN for orders paid in złoty) to your original payment method, whatever rating you give.

How we moderate content. We may decline to publish, or remove, content that breaks this section or the law. Our team reviews content, helped by our review provider’s tools, which can flag content automatically, but a person makes the final decision. If we remove your content, we will tell you why. You can ask us to reconsider by emailing help@desky.eu.

If you think content on our website is unlawful, email help@desky.eu with where it is, why you think it is unlawful, and your name and email address. We will review it and tell you what we have done. help@desky.eu is also our point of contact for authorities.

If you send us ideas or suggestions, we may use them freely and do not have to keep them confidential or pay for them.

17. Our liability

We are liable to you in accordance with the law. We do not exclude or limit our liability for: death or personal injury; damage caused intentionally or through gross negligence; fraud; defective products under product liability law; or your rights under the legal guarantee and other mandatory consumer law.

Otherwise, we are not responsible for loss that neither you nor we could reasonably have foreseen when the contract was made. For our free online services, such as your account and the newsletter, we are not responsible for temporary unavailability, except where caused intentionally or through gross negligence.

18. Complaints and dispute resolution

If something has gone wrong, contact us by email at help@desky.eu, by phone (section 1) or by post to the address in section 1, with your order number and a description of the problem. We will reply within 14 days at the latest.

Consumer mediation. If you have first tried to resolve your complaint with us in writing and we have not resolved it, you can refer it free of charge to our consumer mediator, CM2C, 49 Rue de Ponthieu, 75008 Paris, France (tel. +33 (0)1 89 47 00 14, https://www.cm2c.net). You can submit your request online at https://www.cm2c.net or by post to that address. You must do so within one year of your written complaint to us.

For a cross-border complaint, the European Consumer Centre in your country can help you free of charge.

19. Governing law and courts

These terms and your contract with us are governed by Polish law. The UN Convention on Contracts for the International Sale of Goods does not apply.

If you are a consumer, this choice of law does not take away the protection of the mandatory law of the country where you live. You can bring proceedings in the courts of Poland or of the country where you live, and we can only bring proceedings against you in the courts of the country where you live.

20. Accessibility

We design desky.eu to meet the accessibility requirements of the European Accessibility Act, and we apply WCAG 2.2 Level AA. Our Accessibility Statement explains how the website meets those requirements and how to contact us for help or an accessible alternative.

21. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the version published when you placed it. We do not change the terms of an order you have already placed.

If we change the terms for your customer account or newsletter, for example because the law changes or we add new features, we will email you at least 14 days before the change takes effect. If you do not agree, you can close your account or unsubscribe before then at no cost.

22. Other provisions

If a court finds any part of these terms invalid or unenforceable, the rest of these terms remain in force, and the relevant legal provisions apply in place of the invalid part.

If we do not enforce a right under these terms straight away, we can still enforce it later.

The headings in these terms are for convenience only.

23. Additional terms for business customers

This section applies only to business customers (see section 2).

23.1 Your terms. Our terms apply to your order. We do not accept your own purchasing or other terms, even if you refer to them in a purchase order, unless we agree to them in writing.

23.2 Trade, commercial and bulk orders. Orders placed on our website are at the prices shown, with free delivery, whatever their size or value. For trade, commercial or bulk pricing, contact us at help@desky.eu. Any such order is agreed with you separately in writing.

23.3 VAT. We charge VAT on every order, including orders from business customers, and we do not supply goods VAT-free under the reverse charge. If you need a VAT invoice, email help@desky.eu with your order number and your company name, address and VAT number, and we will issue one. Invoices to business customers in Poland are issued through the National e-Invoicing System (KSeF).

23.4 No change-of-mind returns. Business customers have no right of withdrawal, and the voluntary 30-day return period in section 10 does not apply. We will accept a return other than for a defect only by written agreement.

23.5 Risk. Risk of loss or damage passes to you when we hand the goods to the carrier.

23.6 Inspection. You must inspect the goods on delivery. Note any visible damage or missing cartons on the carrier’s delivery record, and tell us in writing within 3 business days of delivery. Tell us about a hidden defect within 7 days of discovering it. If you do not, the goods are treated as accepted, except for defects we fraudulently concealed.

23.7 Defects. Our statutory liability for defects in new goods (rękojmia) ends 12 months after delivery. If goods are defective, we will first repair or replace them, at our choice. If that fails, you can ask for a price reduction or, if the defect is material, end the contract for the affected goods. This does not apply where we fraudulently concealed a defect. The Desky Warranty applies to business customers on the same terms and for the same periods as set out on the Warranty page.

23.8 Liability. Our total liability under or in connection with an order is limited to the price paid for that order. We are not liable for indirect or consequential loss, loss of profit, revenue or savings, business interruption or loss of data. These limits do not apply to liability for death or personal injury, damage caused intentionally or through gross negligence, fraud or fraudulent concealment of a defect, or liability under product liability law.

23.9 Retention of title. The goods remain our property until we have received payment in full of everything you owe under the order.

23.10 Law and courts. Polish law applies and the UN Convention on Contracts for the International Sale of Goods is excluded. The courts with jurisdiction over our registered office in Poznań have exclusive jurisdiction, but we may also bring proceedings in the courts where you are established.
