("Desky", "we", "us" or "our") operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us, and the rights you have in relation to it.

4.1 Provide, Tailor, and Improve the Services.
We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfil your orders, to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a personalised shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Services. Legal basis: performance of our contract with you (Art. 6(1)(b) GDPR) and, for tailoring and improving the Services, our legitimate interest in offering a relevant, well-functioning store (Art. 6(1)(f) GDPR). 4.2 Delivery.
We share your name, delivery address, phone number and email address with our warehouse and carriers so they can book and complete your delivery. Bulky items such as desks cannot be delivered without a contact phone number. Legal basis: performance of our contract (Art. 6(1)(b) GDPR).
4.3 Returns, Warranty and Product Safety.
We use your order and contact details to handle withdrawals, returns and warranty claims, and to contact you if a product you bought is subject to a safety notice or recall. Legal basis: performance of our contract (Art. 6(1)(b) GDPR) and compliance with our legal obligations, including under the EU General Product Safety Regulation (Art. 6(1)(c) GDPR).
4.4 Marketing and Advertising.
We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Services or other websites, including based on items you previously have purchased or added to your cart and other activity on the Services, which involves building a profile of your interests. 4.5 Security and Fraud Prevention.
We use your personal information to authenticate your account, to provide a secure payment and shopping experience, detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and to secure our services. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password or other access details with anyone else. Legal basis: our legitimate interest in protecting our store, our customers and payments against fraud and misuse (Art. 6(1)(f) GDPR). When you visit the store, Shopify's servers automatically record technical access data (such as your IP address, date and time, pages requested and browser) to deliver the store and keep it secure. 4.6 Communicating with You.
We use your personal information to provide you with customer support, to be responsive to you, to provide effective services to you and to maintain our business relationship with you. Legal basis: performance of our contract where your request relates to an order (Art. 6(1)(b) GDPR), and otherwise our legitimate interest in answering you (Art. 6(1)(f) GDPR). Where our chat or customer support uses an automated assistant, we tell you when you are talking to one, and you can ask for a person at any time. We record phone calls only if you agree at the start of the call, to check the quality of our support, train our team and keep a record of what was agreed. If you do not agree, the call is not recorded. Legal basis: your consent (Art. 6(1)(a) GDPR).
4.7 Legal Reasons.
We use your personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to keep accounting and tax records, to investigate or participate in potential or actual legal proceedings, and to enforce or investigate potential violations of our terms or policies. Legal basis: compliance with our legal obligations (Art. 6(1)(c) GDPR) and our legitimate interest in establishing, exercising or defending legal claims (Art. 6(1)(f) GDPR).
Information marked as required at checkout or in a form is needed to enter into and perform our contract with you, or to answer your request. If you do not provide it, we cannot take or deliver your order. Everything else is optional.
We do not make decisions that produce legal effects concerning you, or similarly significantly affect you, based solely on automated processing. Orders flagged by our fraud checks are reviewed by a person. If you choose to pay with Klarna, Klarna carries out an identity and credit check and decides whether to offer that payment method, under its own privacy notice.

We use cookies and similar technologies that are strictly necessary to run the store. We use all others only with your consent (Art. 6(1)(a) GDPR), which you give or refuse in our cookie banner by category. We have pages on Facebook and Instagram and advertise through Meta and TikTok. For page statistics, and for collecting and sending data through their pixels and server-side events, we are joint controllers with Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland, and TikTok Technology Limited, 10 Earlsfort Terrace, Dublin 2, Ireland. We use these tools only with your consent. Each platform is responsible for its own later processing, described in its privacy policy. You can exercise your rights with us or with the platform. We also run global Desky pages on LinkedIn, YouTube and Pinterest. If you visit them, the platform processes your information under its own privacy policy. For LinkedIn page statistics, we are joint controllers with LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland.
The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.
We use appropriate technical and organisational measures to protect your personal information, including encrypted connections, access controls and contracts with our service providers. Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.
How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide you with Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies. In particular:

We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you or by contacting us. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.

You have the right to ask us to restrict our processing of personal information in certain circumstances, for example while we check a correction you have asked for.

Where we rely on consent to process your personal information, you have the right to withdraw this consent at any time. If you withdraw your consent, this will not affect the lawfulness of any processing based on your consent before its withdrawal.

We may need to verify your identity before we can process your requests, as permitted or required under applicable law. We will respond within one month of receiving your request. We may extend this by up to two further months for complex or numerous requests, in which case we will tell you within the first month. If we do not act on your request, we will tell you why, and you may complain to a supervisory authority.

You also have the right to lodge a complaint with a data protection supervisory authority. Some of our service providers, and our group company Desky Pty Ltd, are located outside the European Economic Area (EEA). Where we transfer your personal information outside the EEA, we rely on either an adequacy decision of the European Commission (for example, for Canada, and for United States companies certified under the EU-US Data Privacy Framework) or the European Commission's Standard Contractual Clauses (for example, for transfers to Australia, including to Desky Pty Ltd and Okendo, and to United States providers that are not certified). We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website and update the "Last updated" date.
